1. Acceptance of Terms

By accessing or using the 256 Blocks platform, website, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes acceptance of those changes.

2. Description of Services

256 Blocks provides blockchain infrastructure services including, but not limited to:

  • RPC endpoint access for various blockchain networks
  • Policy-based access control for blockchain interactions
  • Gas sponsorship and transaction management
  • API access and developer tools
  • Dashboard and analytics features

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials and API keys
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access or use of your account

4. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Engage in fraudulent, deceptive, or misleading activities
  • Distribute malware, viruses, or other harmful code
  • Attempt to gain unauthorised access to our systems or networks
  • Interfere with or disrupt the integrity or performance of the Services
  • Engage in money laundering or terrorist financing
  • Facilitate illegal gambling or other prohibited activities

5. Prohibited Activities and Service Abuse

The following activities are strictly prohibited and may result in immediate termination of your account without notice or refund:

  • Denial of Service Attacks: Any attempt to overwhelm, disrupt, or impair the availability of our Services or infrastructure through excessive requests, distributed attacks, or any other means
  • Rate Limit Circumvention: Bypassing or attempting to bypass rate limits, quotas, or other usage restrictions
  • Resource Abuse: Using the Services in a manner that consumes excessive resources or degrades performance for other users
  • Automated Abuse: Using bots, scripts, or automated tools in ways not authorised by our API documentation
  • API Key Sharing: Sharing, selling, or distributing your API keys to unauthorised third parties

We reserve the right to take any action we deem necessary to protect the Services and our users, including blocking IP addresses, suspending accounts, and pursuing legal remedies.

6. Payment and Billing

Certain Services require payment. By subscribing to paid Services, you agree to:

  • Pay all fees in accordance with the pricing and payment terms
  • Provide accurate and complete billing information
  • Authorise us to charge your payment method for all fees incurred

All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change our prices with reasonable notice.

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by 256 Blocks and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit through the Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of providing the Services.

8. Third-Party Services

The Services may integrate with or rely upon third-party services, including blockchain networks and payment processors. We are not responsible for the availability, accuracy, or reliability of such third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 256 BLOCKS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of cryptocurrency or digital assets
  • Failed or delayed blockchain transactions
  • Service interruptions or downtime
  • Security breaches or unauthorised access

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless 256 Blocks and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may terminate your account at any time by contacting us or using the account settings.

We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Non-payment of fees
  • Suspected fraudulent or illegal activity
  • Actions that may harm 256 Blocks, other users, or third parties

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and 256 Blocks regarding the Services.
